Care level refused or too low? Calculate the objection deadline
The long-term care fund decides on the care level or care benefits, often after an assessment by the Medical Service.
How to recognise the letter
- The sender is the long-term care fund (it sits with the health insurer).
- It is about the care level or care benefits.
- Often the Medical Service's assessment is enclosed or mentioned.
Which deadline applies?
Objection (Widerspruch): one month after notification (§ 84 Abs. 1 S. 1 SGG). If the end falls on a Saturday, Sunday or public holiday, the deadline ends on the next working day (§ 64 Abs. 3 SGG). The calculator on this page works out the exact day – step by step.
Long-term care belongs to the social courts (§ 51 Abs. 1 Nr. 2 SGG); objection within one month.
What happens if you do nothing?
Once the objection period has passed, the decision becomes final. A higher care level then needs a new application.
