Giving notice on your flat in Germany: when does the tenancy end?
As a tenant you give three months' notice – but only if the letter reaches the landlord by the third working day of a month. The calculator shows which month is your last.
The rule
Notice is allowed »at the latest on the third working day of a calendar month to the end of the month after next« (§ 573c Abs. 1 S. 1 BGB). If it arrives on the 3rd working day of October, the tenancy ends on 31 December; one day later, only on 31 January.
What matters
- Receipt by the landlord counts, not the postmark. Registered mail (Einwurf-Einschreiben) or handing it over with a witness helps you prove it.
- Only in writing with a handwritten signature – an e-mail is not enough (§ 568 Abs. 1 BGB). With several tenants, all sign.
- Whether Saturday counts as a working day is disputed. We count it – so the calculator shows the earlier cut-off date.
Did your landlord give you notice? Then other rules apply: Notice (flat).
General information, not legal advice. Fixed-term leases, waivers of notice and furnished rooms in the landlord's flat have their own rules – a tenants' association (Mieterverein) helps.
